Youth Environmental Art Competition Ownership Acknowledgement
Ownership Rights. Artist acknowledges that upon the submittal of artwork to the City of Concord (City), the City will own and retain all rights, title, and interest in and to the artwork including term and location of use, if the Artist’s work is selected. If the Artist’s work is not selected then the Artist retains their ownership and control over the piece.
The City desires to display the artwork as originally created by Artist and to maintain the artwork in good condition. However, City will have flexibility to operate and manage the artwork as City property. Artist therefore agrees that the City shall have the absolute right incidental to its ownership of the artwork to alter, change, modify, destroy, remove, relocate, move, replace, transport, or transfer, in whole or in part.
These rights also include, but are not limited to; the right to reproduce, distribute, and publish submitted images for display purposes. City may reproduce the artwork and use reproductions for the following purposes: educational or promotional events or materials, advertising, print, broadcast, film, electronic, social, and multimedia publicity, documentation of City art, brochures, catalogues or similar publications, and similar non-commercial purposes.
Credit. The Artist acknowledges they will have no ownership over the submitted piece; however, the City agrees to credit the Artist as the author of the work in all uses of the work. Artist agrees that all formal references to the Artwork and any reproductions of the Artwork in any form shall include the following credit: “Created for the City of Concord, California.”
Originality of Artwork. Artists certify that: (a) the artwork is their own original work, of which they are the sole creator; and (b) the Artwork is unique and original and was not generated using AI or infringe upon any copyright, trademark, or other intellectual property rights.
Note : Artwork is ineligible for any of the following reasons:
- Contains copyright or marketing materials
- Is plagiarized, stolen, copied from another source, or generated by AI
- Contains matter that is or can be seen as obscene, political, or inappropriate
Information and Release. City shall have the right to use Artist’s name, and biographical information (unless Artist opts out of permitting use of Artist’s information and specifies the personal details that can be shared publicly in the submission form), in connection with the display or reproduction and distribution of the Artwork including all advertising and promotional materials. Artist shall make themselves reasonably available to attend any inauguration or presentation ceremonies relating to the public unveiling and/or dedication of the Artwork and related public relations events.
Public Records Requests. Any documents provided by Artist to City are public records and City may need to reproduce such documents to third parties, pursuant to all applicable laws, including public records laws such as the California Public Records Act.
